Data Privacy Notice Regarding Processing of Personal Data in Procedures for Sharing Gratitude, Request, Suggestion and Complaint

1.Purpose and Scope

This data privacy notice is prepared by Denizbank Anonim Şirketi in data controller capacity within the scope of the Communiqué Regarding the Terms and Principles to be Followed in Fulfilling the Notification Obligation and the article 10 of the Personal Data Protection Law No. 6698 (“LPPD”).

We kindly ask you not to include any sensitive personal data in your request, complaint, gratitude and/or suggestion letter (race, ethnicity, political view, philosophical belief, religion, sect or faith in general, appearance, association, foundation or union membership, health, sexual life, criminal conviction and security measures, biometric and genetic data).

2.Your Personal Data Processed and Methods of Collection

Your personal data under the categories Identity (name, surname, ID number), Communication (phone number, email address), Customers Transactions (messages sent through communication channel), Visual and Audio (processed if only you contact us through the call center or send us visual content within the scope of your request/complaint/suggestion), and Finance are collected through physical and/or electronic media, in partially automated ways or provided that they are part of any data registry system in non-automatic ways, when you fill in forms at our head office, branches or online forms on our website, when you reach us through communication channels such as mail, e-mail, telephone, fax or telephone banking or through other means which can added afterwards or when you submit them through complaint platforms or social media platforms; your personal data under the category Legal Proceedings (which can be processed only in case of a legal conflict) are collected from authorized public institutions and organizations through automated or non-automated means. If you contact us through our digital channels such as our website, your personal data under the category of Transaction Security (such as IP address) will be processed.

3.Legal Causes and Purposes as to Why We Process Your Personal Data

Your personal data under the categories Identity, Communication, Customer Transactions, Finance, Transaction Security, Visual and Audio, and Legal Proceedings are processed based on the legal grounds that “the personal data of the contractual parties requires to be processed provided that they are directly related to the establishment or performance of the contract” as per the Article 5/2 (c) of the Personal Data Protection Law, and that “It is necessary for compliance with a legal obligation to which the data controller is subject.” as per the Article 5/2 (ç) of the same Law and subparagraph (e), which stipulates " Data processing is necessary for the establishment, exercise or protection of any right.” for us to fulfill our obligations within the scope of management of customer relations, customer satisfaction and communication activities, management of requests/complaints/suggestions, management of audit activities, tracking legal proceedings, ensuring business continuity, management of custody and archive activities, execution of information security processes, and our legal retention, reporting and notification responsibilities.

4.To whom and for what purpose the processed personal data can be transferred

Your personal data will be shared with those from whom we receive services within the scope of management of customer management processes and monitoring of the legal proceedings (for example with legal advisors, companies receiving call center service) and with the institutions and organizations which are legally authorized to obtain information within the scope of fulfillment of our legal liabilities, monitoring of legal proceedings/compliance issues, and fulfillment of our obligation to inform and report based on the legal grounds that “It is necessary for compliance with a legal obligation to which the data controller is subject” as per the Article 5/2 (ç) of the Personal Data Protection Law and subparagraph (e), which stipulates "Data processing is necessary for the establishment, exercise or protection of any right.” and subparagraph (f) stipulating " Processing of data is necessary for the legitimate interests pursued by the data controller, provided that this processing shall not violate the fundamental rights and freedoms of the data subject.”.

5.Your Rights Related to Your Personal Data

As per the “Communiqué on the Procedures and Principles for Application to the Data Controller”, you can send your requests within the scope of Article 11 of the LPPD which regulates the rights of the data subject;

  • Provided that you verify your identity, through a written petition to the attention of our Head Office located in Büyükdere Cad. No: 141 34394 Esentepe-İSTANBUL or any of our branches or via notary public,
  • By e-mail to denizbank.haberlesme@hs09.kep.tr using your registered e-mail address,
  • Tooncemusteri@denizbank.com by e-mail, including secure electronic signature or mobile signature, or
  • By using your e-mail address that you have previously reported to our bank and registered in our system, oncemusteri@denizbank.com
